Collaborative Divorce
Burley Financial Services Ltd are please to be active in the area of Collaborative work. We believe that a truly Collaborative case requires a Financial Neutral and possibly a Financial Implementer. We also believe that in some cases the Financial Neutral is the only truly neutral individual involved in the process. Legal representatives have a duty to their clients, where as the Financial Neutral has a duty to be neutral, fair and honest, to both parties and their representatives.

We always have to remember the basic principles of Collaborative work and we have to assist the parties to reach a settlement. At the end of the day it is their settlement, not ours, not their legal representatives, and certainly not the courts.

The role of a Financial Neutral is not straight forward as the role may change case by case, however the duties should include all or part of the following;
  • Explaining the role of the Financial Neutral and the Implementer.
  • 3 way or 5 way meetings may be required to discuss the requirement of protecting any agreed maintenance payments while the process is ongoing. This may also have to be done at the end of the process.

  • Assisting an informed, amicable and agreed settlement that the parties agree to.
  • Hand over to an implementer, who may identify other needs for the parties going forward.
